Entrust America Provides New Solutions To Consumers Affected By Supreme Court’s Ruling

At issue was whether insurance companies were required by the Fair Credit Transactions Act to disclose to consumers that they did not qualify for the lowest insurance rates due to their credit score. In a unanimous judgement earlier this week, the U.S. Supreme Court ruled that insurers were not required to notify consumers that their insurance premiums may be higher due to their credit score.

“Consumers can best protect themselves against high insurance premiums by using a credit score monitoring system or a credit score recall program to immediately improve their credit score”, says Mr. Stoll. The Supreme Court overturned a San Francisco-based 9th district Court of Appeals decision that would have been a win for the consumer. American consumers lost a degree of legal protection and now must individually take steps to protect themselves against being penalized by the nation’s insurance companies. The majority of consumers are not aware that most insurers only offer their best rates to individuals with top credit scores.

Those who can least afford to pay higher insurance premiums tend to have the lowest credit scores. According to the Washington Post, “(those with low scores) are young, minorities, immigrants or members of ethnic groups that avoid use of the traditional banking system. They end up paying high rates and fees.”

Insurance bills for those with low scores can be costly. “The low credit score penalty is steep, adding perhaps as much as 50 percent to an insurance bill”, says Birney Birnbaum of the Center for Economic Justice in Austin, Texas.

If consumers want access to the best insurance rates, their only recourse is to maintain a high credit score and take steps to ensure their score is protected. The Supreme Court decision removes the burden of full disclosure from the insurance companies.
