Creating a niche on the South Shore, Accord Mediation offers clients a much more efficient, rhetoric-free and civilized way to reach a resolution that is agreed upon by both parties. In a mediation session lasting approximately three hours, disputing parties will agree to a settlement and sign appropriate documentation before they leave.

And, mediation settlements are typically much more acceptable to all parties than any court imposed settlement because the disputing parties maintain control. In court with a judge and jury, they would have not control at all.

“Mediation simple makes sense. Taking the case to trial court is a length and expensive process. Many people end up losing out on a sum they have been awarded because it’s consumed by attorney fees. Hughes, a resident of Norwell and the town’s Moderator for 24 years, has served as a trial lawyer for more than 30 years. He’s a graduate of Princetown University and Boston College Law School and is a Certified Professional Mediator.

As a trial lawyer, Hughes has the ability to view each side of mediation objectively. Unlike former judges who serve as mediators and practice the same “mediation” techniques used in a court of law where the parties are not granted a choice. Hughes’ practice focuses on enabling the disputing parties to independently work out their own solutions.

According to Hughes, “Our job is to help the parties find a solution on their own. We tone down the rhetoric and the emotion. As mediators, we eliminate the third party in the decision process-those who would ultimately make a decision for the disputing parties – which in a court of law would be judge and jury. Most importantly, with mediation, the disputing parties maintain control of the outcome. Our job as mediators is to objectively, legally and calmly facilitate a resolution.”

Mediation Defined
Mediation is the process of finding a solution to a dispute, claim or other issue through communication facilitated by a certified mediator. There are several unique aspects of mediation that are beneficial to both parties. First, no one is bound to a third party’s decision of the dispute, Once a suitable agreement has been reached by the disputing parties; it is documented and signed by both parties. Secondly, what is said during mediation cannot be used in a trial and the mediator cannot be called upon to serve as a witness. Lastly, mediation is confidential and the results are not revealed to any third party.
