ReSoft International and LitigationProofing, LLC have today released an important paper on the “Seven Deadly Sins of Electronic Communications and how you can protect against them.”

The omnipotence of e-mail and instant messaging in business has allowed electronic communications to become the most fertile source of litigation expense and difficulty.

The persistence of the electronic record and the routine recovery of electronic communications in connection with almost every business dispute or investigation means that the litigation complications recently faced by investment firms such as Citicorp or Merrill Lynch or pharmaceutical manufacturers such as Merck as a result of problematic e-mails are now becoming commonplace. Sooner or later your firm will face such a problem, and this new paper can help you reduce the risk and minimize the potential damage.

ReSoft International has partnered with LitigationProofing, LLC to publish this paper, which is designed as a primer to enable IT, Legal and Compliance, and Human Resources Departments to develop and deploy appropriate policies and practices and implement useful employee training. The paper is based upon experience gained by LitigationProofing, LLC in years of litigation practice and through educational workshops to its clients. Some of the issues addressed include:

- Assuming "delete" effectively erases the e-mail trail.
- Using company e-mail for personal use.
- Creating untruthful content by inappropriate conventions in e-mail composition.

Clive Horton, CEO of ReSoft says "Much of the focus on e-mail compliance today is in applying technology to capture copies of problematic e-mails after the event. Setting up a more pro-active education & awareness plan with employees can address many of these behavioral issues before the e-mail is even created".

Eric M. Rosenberg, President of LitigationProofing, LLC adds "While e-mail is a useful business tool, inappropriate use has tarnished the public image of many firms and led to numerous litigation problems that could have been avoided with appropriate employee training and supervision."

A free copy of the paper, "The Seven Deadly Sins of Electronic Communications and how you can protect against them" can be requested from www.re-soft.com/7DeadlySins for a limited time (registration required).

On request, ReSoft and LitigationProofing can provide further support in assisting organizations to develop effective training and acceptable use policies.
