According to a report broadcast on CTV News on February 23rd, the two class actions claim that patients were not properly warned of the serious risks associated with the company's inferior vena cava (IVC) filters, including their potential to fracture and migrate to other parts of the body. Both lawsuits seek millions of dollars in damages on behalf of Canadian patients implanted with the filters. "The filing of these Canadian cases come as hundreds of U.S. plaintiffs pursue their own IVC filter lawsuits against Cook Medical, as well as C.R. Bard, Inc. Court documents indicate that more than 250 Cook IVC filter lawsuits involving the company's Celect and Gunther Tulip blood clot filters have been centralized in a multidistrict litigation now underway in the U.S. District Court, Southern District of Indiana. An additional 84 cases involving C.R. Bard's Recovery and G2 IVC filter are pending in a second multidistrict litigation located in the U.S. District Court, District of Arizona. IVC filters are implanted in the inferior vena cava in order to intercept blood clots before they can travel to the lungs and become a pulmonary embolism. The devices at the center of the Canadian class actions, as well as the litigations underway in the U.S., involve retrievable devices that are intended to be removed once a patient is no longer at risk for pulmonary embolism. However, a study that appeared in JAMA: Internal Medicine in April 2013 suggested that successful IVC retrieval occurred in less than 10% of patients.
In 2010, the U.S. Food & Drug Administration (FDA) disclosed that retrievable IVC filters had been associated with more than 900 adverse events, including incidents of migration, fracture and embolization, and perforation of the inferior vena cava. In 2014, the agency issued a new advisory to remind doctors that retrievable IVC filters should be removed within 29 to 54 days of their implantation.
