February 10, 2016 (PRLEAP.COM) Business News
February 10, 2016 - Federally-filed forced air warmer lawsuits (http://www.rxinjuryhelp.com/forced-air-warming/lawsuit/) involving the 3M Bair Hugger surgical blanket are progressing in the federal multidistrict litigation now underway in the U.S. District Court, District of Minnesota. According to a Pretrial Order issued on February 9, 2016, the Court will convene an Initial Pretrial Conference on Thursday, February 18th at 9:30 a.m. CST. The Order further indicates that a number of issues may be addressed during the Conference, including the structure of plaintiffs' leadership and the status of state court proceedings. (In Re: Bair Hugger Forced Air Warming Products Liability Litigation – MDL No. 2666)"Our attorneys are continuing to evaluate potential Bair Hugger lawsuits on behalf of patients who suffered serious hip and knee replacement infections allegedly associated with the use of this surgical warming blanket. We look forward to the next week's Conference, as well as further developments in the weeks and months ahead," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is offering free, no-obligation legal review to hip and knee replacement patients who allegedly developed post-operative deep joint infections due to the Bair Hugger forced air warmer system.
Bair Hugger Allegations
The Bair Hugger forced air warmer system was designed to prevent hypothermia in patients undergoing surgeries. The apparatus consist of a portable heater/blower connected by a flexible hose to a disposable blanket that blows hot air on a patient's exposed skin. According to Bair Hugger lawsuits, the device has been used to warm more than 100 million surgical patients since its introduction in the late 1980s, and is currently used by four out of five U.S. hospitals.
Court records indicate that at least 82 hip and knee replacement infection lawsuits involving the Bair Hugger have been filed in the District of Minnesota against the 3M Company and its subsidiary, Arizant Healthcare, Inc. Plaintiffs allege that the Bair Hugger suffers from a design defect that results in disruption of laminar flow in the operating room, allowing bacteria and other contaminants from the floor to enter the surgical site. This flaw greatly increases risk that hip and knee implant patients will develop serious post-operative joint infections. They further allege that 3M and Arizant have been aware of this problem for years, yet failed to make design changes or issue any warnings to the medical community.
Individuals who developed a serious deep joint infection following hip or knee replacement surgery that involved the use of this forced air warming blanket may be entitled to file their own 3M Bair Hugger lawsuit.
