Bair Hugger Lawsuit News: Federal Forced Air Warming Litigation Issues First Pretrial Order, Bernstein Liebhard LLP Reports

January 19, 2016 - The federal multidistrict litigation established in the U.S. District Court, District of Minnesota, for 3M Bair Hugger lawsuits (http://www.rxinjuryhelp.com/forced-air-warming/lawsuit/) involving the forced air warming blanket's alleged association with dangerous post-operative infections has begun to move forward. According to Pretrial Order No. 1 issued on January 13th, the Court intends to convene regular status conferences beginning on a yet-to-be determined date in February. The federal Bair Hugger litigation was established in December 2015, so as to promote judicial efficiency by allowing all federally-filed hip and knee infection lawsuit involving the forced air warming blanket to undergo coordinated pretrial proceeding. Marketed by the 3M Company and its Arizant Healthcare, Inc. subsidiary, the 3M Bair Hugger has been used in millions of hip and knee replacement procedures to help patients maintain an optimal body temperature during surgery. While just 14 cases were initially transferred to the federal multidistrict litigation, court documents indicate that at least 82 Bair Hugger complaints were pending in the District of Minnesota as of January 15th. Plaintiffs who sought centralization of the docket maintained that the multidistrict litigation could eventually house hundreds of lawsuits, given the widespread use of the Bair Hugger apparatus.

All of the currently pending Bair Hugger lawsuits similarly allege that the surgical blanket suffers from a design defect that may cause the surgical site to come into contact with bacteria and other contaminants from the operating room floor. The complaints also charge that 3M and Arizant concealed this risk and failed to conduct adequate and sufficient post-marketing surveillance of the device.
