Wright Conserve Hip Lawsuit Attorneys at Bernstein Liebhard LLP Comment on $11 Million Verdict in First Federal Bellwether Trial

November 25, 2015 - The first federal bellwether trial involving a Wright Conserve hip lawsuit concluded on November 24th, after the jury hearing the case awarded the Plaintiff $1 million in compensatory damages, along with $10 million in punitive damages. The $11 million verdict followed two weeks of testimony in the U.S. District Court, Northern District of Georgia, where more than 500 similar claims have been consolidated in a multidistrict litigation.(Case No. No. 13-00297)

All of the cases pending in the Northern District of Georgia were filed on behalf of recipients of the Wright Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System. These plaintiffs allege that the metal-on-metal design of the Conserve hips resulted in the accumulation of excessive metal ions generated by the implants, which caused serious and debilitating complications including metallosis, pseudotumor formation, and premature failure of the hip resulting in the need for revision surgery. The Wright hip lawsuit chosen for the litigation's first bellwether trial was filed on behalf of a woman who received a Conserve hip in 2006. In 2012, she underwent revision surgery after being diagnosed with a loose and displaced acetabular cup. However, during the procedure, her surgeon discovered signs of a metallosis reaction of the hip, which had resulted in damage to soft tissue.

Court records indicate that Wright Medical Technology is also facing hundreds of lawsuits over its Profemur Hip Replacement System. In June, a California Superior Court jury awarded $4.5 million to the plaintiffs in the nation's first trial of a Profemur hip lawsuit, after finding that the device was defective and negligently designed. The company was ordered to pay the Profemur recipient $4 million for past and future pain and mental suffering, while his wife was awarded $500,000. (Case No. BC475958)
