Zofran Lawsuit News: More Than 100 Zofran Birth Defects Claims Now Pending in Federal Multidistrict Litigation, Bernstein Liebhard LLP Reports

November 18, 2015 - Zofran lawsuits (http://www.rxinjuryhelp.com/zofran/lawsuit/) filed over the medication's alleged association with serious birth defects continue to mount in courts around the country. According to a report issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on November 16th, there are currently 112 cases pending in U.S. District Court, District of Massachusetts, where all federally-filed product liability claims involving Zofran and birth defects have been consolidated for the purposes of coordinated pretrial proceedings. Zofran Birth Defects Allegations
Zofran is an anti-nausea medication manufactured by GlaxoSmithKline that is indicated to treat post-operative surgery patients, as well as those undergoing certain cancer treatments. The drug has never been approved to treat nausea and vomiting related to pregnancy, and its inclusion in the U.S. Food & Drug Administration's (FDA) Pregnancy Category B indicates that Zofran's effects on a developing pregnancy have not been well-studied. Nevertheless, an analysis published last December in the American Journal of Obstetrics and Gynecology suggested that as many as one million U.S. women annually have been prescribed Zofran or a generic equivalent for this off-label indication.

When the multidistrict litigation now underway in the District of Massachusetts was established by the JPML on October 13th, only a dozen cases were initially transferred to the proceeding. All of the Zofran lawsuits now pending in the litigation similarly allege that Glaxo concealed data linking Zofran to the development of serious birth defects and failed to provide doctors and patients with information regarding this risk. Plaintiffs also accuse the company of improperly marketing the drug as a safe and effective treatment for morning sickness without FDA approval.

Children who allegedly suffered serious birth defects due to their mother's use of Zofran during the first trimester of pregnancy may be entitled to compensation from GlaxoSmithKline.
