3M Bair Hugger Lawsuit Centralization to Be Addressed at JPML's December Hearing Session, Bernstein Liebhard LLP Reports

October 22, 2015 - The proposed centralization of all federally-filed 3M Bair Hugger lawsuits (http://www.3mbairhuggerlawsuit.com/) will be addressed on December 3rd, when the U.S. Judicial Panel on Multidistrict Litigation (JPML) convenes its next Hearing Session in New Orleans, Louisiana. The 3M Bair Hugger is a forced air warming blanket used during surgical procedures to regulate a patient's body temperature. According to court documents, there are currently more than 50,000 Bair Hugger warming systems in the nation's hospitals, and the apparatus has been used to warm millions of patients. However, Bair Hugger lawsuit plaintiffs claim that the forced air warming blanket suffers from a design defect that results in disruption of laminar flow in the operating room, allowing bacteria and other contaminants from the floor to enter the surgical site, thus increasing the risk that hip and knee implant patients will develop serious post-operative joint infections. Court records indicate that at least 14 hip and knee replacement lawsuits have been filed in U.S. courts on behalf of individuals who allegedly developed serious deep joint infections due to the Bair Hugger forced air warming blanket. In August, one of these plaintiffs filed a motion with the JPML seeking to have all such federal claims consolidated in the U.S. District Court, District of Minnesota, in order to reduce duplicative discovery, avoid conflicting pretrial rulings, and serve the convenience of the parties, witnesses and the courts. However, 3M and Arizant have filed a response with the JPML indicating that they are opposed to centralization.
