Mesh Plaintiff Awarded $73M From Boston Scientific After Trial in Dallas, the Rottenstein Law Group LLP Reports

September 10, 2014 - Bloomberg reported on September 9 that plaintiff Martha Salazar has won her lawsuit against Boston Scientific in Texas state court. Salazar had alleged injuries cause by a Obtryx sling device made by the company. The jury found for Salazar and ordered Boston Scientific to pay her approximately $23 million in compensatory damages plus another $50 million in punitive damages. Salazar had sought only $14 million in damages for injuries and pain and suffering. The jury returned with its verdict on the first day of deliberations.* The case is Salazar v. Lopez, no. DC-1214349, District Court for Dallas County, 95th Judicial District of Texas (Dallas).

Boston Scientific won two earlier trials involving the Obtryx sling, and in July, the company won a bellwether trial involving its Pinnacle mesh. In Albright v. Boston Scientific Corp., (Case no. 12-0909; Superior Court of the Commonwealth of Massachusetts, County of Middlesex), Plaintiff Diane Albright had alleged that Boston Scientific had improperly designed the Pinnacle mesh and failed to warn the public about the product's risks, resulting in injuries to her after she received a mesh implant in 2010.**

There are currently more than 12,000 pending lawsuits involving claims by women that various vaginal mesh products made by Boston Scientific erodes after implantation, causing organ damage and pain, according to court filings.**
