Z-AXIS HELPS OBLON, SPIVAK WIN $43.7 MILLION PATENT INFRINGEMENT CASE IN AFG INDUSTRIES V. CARDINAL

DENVER, CO… Z-Axis, one of the top legal presentation strategy firms (www.zaxis.com), was at the forefront of both trial technology and patent infringement as it assisted in the recent win for Oblon, Spivak, McClelland, Maier & Neustadt, P.C. in AFG Industries v. Cardinal. This patent infringement case of patent #4,859,532 involved coated glass products. The jury awarded $43.7 million to Asahi Glass Company, Ltd., a Japanese glass manufacturer, and its subsidiary AFG Industries, Inc., a U.S. glass manufacturer, due to patent infringement by Cardinal IG Co., Inc.

In addition to strategic support and graphics for the Oblon, Spivak team, Z-Axis was in the unique position of providing professional on-site trial technicians to operate the software and facilitate the presentations of both parties.

To support the Oblon, Spivak on behalf of AFG, Z-Axis produced interactive animations, interactive claim chart / infringement checklists, timelines, and damages charts for this case. The animations were mainly tutorials depicting the manufacture and operation of the coated glass products. The interactive timeline used documents from several other companies to show their difficulties in controlling color and reflectance before the patent. After the issuance of the patent the timeline showed these same companies now could control those parameters by using the patented technology.

Z-Axis also provided interactive claim check-off lists that compared all the accused products with the claim terms. As each item on the drawing of the accused product was highlighted, the lawyers could mark the check-box on the screen to clearly show that each element of the claim was present.

Counsel for the opposition, Sidley, Austin, Brown & Wood, contacted Oblon to see if Z-Axis would be able to supply trial support services to them as well. Both firms reached a “gentlemen’s agreement” regarding the use of a single firm (Z-Axis) to supply the Vu-Point graphics display software and operator-technicians for each side. Z-Axis provided two systems and two operators who worked independently for each side. Both Oblon Spivak and Sidley Austin were pleased with the quality and integrity of the courtroom support they received.
