INTERMITTENT LEAVE ISSSUES: REMEDYING EMPLOYER HEADACHES CAUSED BY EMPLOYEE MIGRAINES

November 02, 2007 (PRLEAP.COM) Business News
Philadelphia, PA —- On November 28, a unique and informative management breakfast briefing dealing with Intermittent Leave issues will be sponsored by the Labor Relations and Employment Law Department of the Philadelphia-based law firm of Obermayer Rebmann Maxwell & Hippel LLP. The briefing will be held at the Sheraton Philadelphia City Center Hotel in Philadelphia from 8:30 AM to 10:30 AM. Registration and breakfast will begin at 8:00 AM.
Intermittent Leave issues have become an increasingly thorny problem for employers: according to the U.S. Department of Labor, 27.8% of Family Medical leaves are intermittent.
Compliance with the intermittent leave regulations poses significant challenges for employers. The definition of a “serious health condition” is vague. For example, if an employee contracts the flu and misses three days of work and sees a doctor, does that
person have a serious health condition? Is that person entitled to intermittent leave for a
follow-up visit a week later? Can the individual be required to schedule an appointment after working hours? Can a migraine sufferer leave work every time a headache occurs? What if headaches occur on sunny Friday afternoons? How does one know whether an absence is a protected intermittent leave or a violation of a company’s attendance policy?
To provide relief for such employer headaches, attorneys Jacqueline Gallagher and Lori Halber will answer all questions and provide necessary remedies.
